CONTRACT
This booking agreement ("Agreement") incorporates the contract made by (“Client”) and covers agreements related to MHS performance obligations at the
(Event Type) (“Engagement”)
on (Event Date) from (Event Start Time) to (Event End Time)
at (Event Venue) (“Venue”).
Upon the signing of this Agreement, Client agrees to pay to MHS a total of (Total Due), with an initial deposit of (Deposit) due now. The remainder shall be payable to the individual musicians in the amounts provided to Client by MHS 2-3 weeks before the Engagement, and payments can be made any time after Client receives the musician payment information, but no later than immediately upon arrival of the Engagement. In the event final payment is not made upon the conclusion of the Engagement, a late fee of $20 per day will be assessed to Client.
In the event that the services of MHS is canceled more than 1 month before the event, the 50% deposit is non-refundable. If Client cancels 1 month or less before the date of the Engagement, the outstanding balance shall be remitted to MHS no later than the date of the Engagement.
In the event Client requests to change the instrumentation of the ensemble after the signing of this Agreement resulting in the cancellation or replacement of one of more musicians, a fee of $100 per hour per canceled musician will be due, provided that it is more than 1 month before the date of the Event. If the requested cancellation/replacement of a musician occurs 1 month or less from the date of the Engagement, a fee of $200 per hour per canceled musician will ensue.
In the event of a cancellation on the part of the Client or MHS as a result of an earthquake, fire, pandemic, or other natural disaster, MHS will use its best efforts to accommodate a requested rescheduling of the event and the non-refundable portion of the fee will be applied to the new event date. Notwithstanding the forgoing, if the musicians are not available on the new date, MHS is not responsible to refund the deposit.
In the event of a requested relocation of Venue on the part of the Client or MHS as a result of an earthquake, fire, pandemic, or other natural disaster, MHS will use its best efforts to accommodate a requested change of Venue, provided the Venue is within 10 miles of the originally contracted location. Additional travel fees may apply. For distances more than 10 miles from the originally contracted location it is at the discretion of MHS regarding the acceptance of the change of Venue. If the change of location is due to some other personal reason other than a natural disaster, it is at the discretion of MHS regarding the acceptance of the change of Venue and additional travel fees may apply.
Client shall provide all musicians the following:
  • An armless chair for each musician
  • A location where guests will remain at all times at least 15 feet from the musicians
  • Protection from direct sunlight and any precipitation (Please note that a 3-sided 10x10 tent provided by Client will be required for outdoor performances if there is any threat of precipitation
  • Vendor meals if hired for three (3) or more hours
  • Parking for Musicians (Client is responsible for any parking fees incurred)
MHS may take up to a ten (10) minute musician break per hour, for each performance hour hired.
